| 摘 要： | 善意取得制度是近现代各国物权法的一项重要法律制度,本文在简要回顾西方主要国家善意取得制度发展过程的基础上,根据善意取得制度的有关理论,结合我国民事法律中与善意取得制度相关的规定,从学术上探讨了目前我国确立善意取得制度的必要性、原则、构成要件和效力等问题。
