| 摘 要： | 对被害人诉讼权利的保护是刑事诉讼中保障人权的重要方面,也是刑事诉讼机制科学化、公正化的价值体现。我国《刑事诉讼法》将被害人列为当事人,并赋予了一定的诉讼权利,从而确立了其在刑事诉讼中的地位,但尚有欠缺。应根据被害人诉讼权利保护的实际现状,建立与完善保护被害人诉讼权利的机制和法律。

| Abstract: | Protection of injured party's lawsuit right i s an important respect, which ensures human rights in the criminal lawsuit, it i s also reflect of scientific fair value in criminal suit mechanism process. Our country's 1996 Criminal Procedure Law classifies the injured party as the party, and entrusted to certain lawsuit right, thus established its position in crimin al suit, but still deficient. The mechanism and laws should be set up and perfec ted which protect injured party's lawsuit right according to the real current si tuation. |
