| 摘 要： | “非法占有目的”产生的时间在刑法界越来越引起大家的关注,尤其是在界定合同诈骗案件当中此罪与彼罪、罪与非罪显得非常重要。“非法占有目的”在合同诈骗罪中只能产生于财物所有人交付(处分)财物之前,在合同诈骗案中不存在所谓的“事后故意”。

| Abstract: | 'The emerging time of occupying illegally as object' has been attracting more and more attention in the field of criminal law,especially important in distinguishing different crimes,being guilty or guiltless in the crime of swindling in contract.'The emerging time of occupying illegally as object' in the crime of swindling in contract only exists before the owner's disposing of the property,and there is no afterwards intention in the crime of swindling in contract. |
