摘    要:由于认识和制度设计上的缺陷,我国社会中还存在着受教育权不平等的现象。受教育权对于国家、社会和个人都具有重要的意义,教育作用的本质体现是,教育成为每一个社会成员得以发展的动力,是其向上流动的前提。我国同世界各国一样,都在包括宪法在内的一系列重要的法律文件中规定了公民平等的受教育权以及政府为此所承担的义务,并把它作为建设和谐社会的当然内容。我们应当在法治的轨道上解决这些问题。

Abstract:Owing to the limitations of both cognition and the design of system,the phenomenon that people do not enjoy equal right of education still exists in China.Equal right to education is very important for a country,for a society and for everybody.The essence of the function of education is that education should motivate each society member to develop and perfect himself.In China,like in many other countries,citizens' equal right to education and the government's corresponding obligations have been expounded in a series of important legal documents,including the Constitution of PRC,which are most necessary for building a harmonious society.We should depend on legal system to solve the existing problems.
