| 摘 要： | 刑事政策是国家和社会基于相对公正理性而选择的犯罪防控对策系统。刑事政 策与刑事法律二者之间关系可以从三个层面进行概括:在价值取向上,刑事政策与刑事法律是 指导与被指导的关系;在对策系统上,刑事政策与刑事法律是整合与被整合的关系;在具体措 施上,刑事政策与刑事法律是校正与被校正的关系。

The Relationship between Criminal Policy and Criminal Law |

| Abstract: | Criminal policy is a countermeasure system of prevention and control of crimes, which is selected rationally by a country and society based on relative justice.The relation ship between criminal policy and crminal law can be generalized as follows;in the field of value,the realtionship between the two is that criminal law is directed by criminal policy, in terms of countermeasure system,criminal law is in conformity with criminal policy,and in the side of specifie measures,criminal kw is rectified by crimminal policy. |
