| 摘 要： | 证明妨碍推定作为证明妨碍的制裁措施之一是恢复被证明妨碍行为破坏了的当事人之间的平衡，理解证明妨碍推定的法理基础必须有证明妨碍行为构成与证明妨碍法效果选择之阶段化视野，并结合证明妨碍制度的制度目标。同时应当以阶段化视野以及多元化制裁措施观理解证明妨碍推定的适用条件：证明妨碍推定的适用条件包括一般证明妨碍行为的构成条件和适用证明妨碍推定的特殊的措施条件。

| Abstract: | Spoliation of evidence is used to restore the balance between the parties that has been destroyed by the act of spoliation. Understanding the legal basis of the spoliation inference means understanding it from a constitutional perspective and understanding the selection effect of laws concerning the spoliation of evidence, combined with the systematic objective of the system of evidence spoliation. At the same time, from a staging view, a view from a diversified sanctions perspective should be taken in order to understand the application, and condition of spoliation, The application condition of the spoliation inference includes the general constitutive conditions of the spoliation act and the special conditions for the application of spoliation inference. |
