| 摘 要： | 基因专利是特殊的专利制度。申请时应注重程序的公开性,本着专利的新颖性、实用性、创造性进行实质审查,其范围应包括基因成分专利和用途专利,在专利基因原材料的提供者和基因专利者的利益平衡中要注意原生权利和衍生权利的区别,注意保护基因提供者的利益。

This paper discusses the various aspects concerning the application and protection of the patented rights, such as publicity in the course application, the difference between the original rights and derivative rights in balancing the interests of the material supplier and the patent applicant. |
