完善我军战时刑事侦查程序的立法考量

作为战时刑事诉讼的不可或缺的重要组成部分，我军现有的战时刑事侦查程序还存在相关军事法规立法层次偏低和启动程序不具有战时适应性、实行程序不尽完善等明显问题。在新修订的我国《刑事诉讼法》已经正式实施之际，建议提高相关军事法规的立法层次，实行具有较好战时适应性的随机性侦查启动模式，完善战时刑事侦查实行程序的特殊规定。

Legislative-Thoughts on Perfection of Criminal Investigation in Wartime

As the important and indispensable part of the criminal proceeding in wartime, the current wartime criminal investigation of our Army is problematic. For instance, the related military regulations are in the lower level within the national legislature system, the starting procedure for application of such regulations is not suitable for the circumstances of the wartime, and the implementing pro- cedure is far from perfection. On the occasion of formally implementing the newly - amended Criminal Procedure Law of our country, the paper proposes that the related military regulations should be put to a higher law - making level, the flexible investigation starting mode with good adaptation to the wartime built and implemented, and the special regulations on the wartime criminal investigation procedures be perfected.
