| 摘 要： | 当代中国历史唯物主义法理学的发展大致经历了政法形态、系统形态和经验形态,分别以张文显、公丕祥和朱苏力为代表,三个形态的分野并不具有严格的时间上的承继关系,而是学术上的流派差别。中国历史唯物主义法理学的新形态应当是法哲学与法社会学的统一。

| Abstract: | As historical materialism jurisprudence develops in China,it has taken in the main three forms: political and legal,systemic,and empirical,with Zhang Wenxian,Gong Pixiang and Zhu Suli as their respective representatives.These forms differ in schools rather than time continuity.The new form of historical materialism jurisprudence should be a unity of legal philosophy and legal sociology in contemporary China. |
