| 摘 要： | 挂靠行为是我国市场经济中存在的一个严重问题,它侵害了市场交易主体的利益,引发了相当多的纠纷。立法对这一问题没有相关规定,司法实践中有关这一问题的操作十分混乱。本文以诚实信用原则为基点,对如何解决这一问题进行了探讨,并提出了相应的立法建议。

| Abstract: | The dependence is a serious problem in our market economy. It hurts the traders' benefit and brings much trouble. There are no responding regulations in the law. The practice of the justice is disordered. This article is based on the principle of the honesty and credit, and its purport is to discuss the way to solve it, as well as to give some suggestions to the legislature. |
