| Abstract: | China's constitution deviates from constitutional government because of the defects in current version. Current constitution cannot solve constitutional issues. It only vests government organs with authority instead of limiting their power so that civil rights cannot be safeguarded. It should be framed by the relation between property rights of citizens and financial power of the State. |
