| 摘 要： | 劳工权益保障已经成为当前经济和社会发展过程中必须要认真解决的问题.劳工权利保障主要涉及到政府、企业和劳动者三元主体之间的博弈:政府面临的主要难题是如何平衡资本利益、政绩需要和劳工权利的矛盾；企业则由于资本的强势权力而表现出对劳工权利的漠视和践踏；劳动者是弱势群体,缺乏组织,维权的成本很高,限制很多.这些构成当前劳工权力保障的现实困局.
