| 摘 要： | 2012年修订的《刑事诉讼法》对控辩关系进行了修正和完善。对辩护律师的会见权、阅卷权、调查取证权的内容进一步扩展，强化了辩护律师的诉讼权利，缓解了控强辩弱的局面。为保障刑事诉讼中新型控辩关系的有效落实，检察机关应与律师协会形成交流机制，制定工作细则，细化对律师诉讼权利的保障并设立维护律师诉讼权利的部门，强化律师诉讼权利受到妨害时的救济。

| Abstract: | Criminal Procedure Law revised in 2012 has amended and improved the relationship between prosecution and defense .In order to quarantee the effective implementation of the new relation between prosecution and defense in criminal proceduse ,procuratorial organs should form exchange mechanism and sense of identity with lawyers asso -ciation,for mulate work rules,refine the protection of lawyers ’ litigation rights,establish relevant departments to maintain lawyers ’ litigation rights ,and streng then the reliet when lawyers ’ litigation rights are obstructed . |
