| 摘 要： | 无罪推定在中国首先是支持与反对之争，即使在支持一方中也对无罪推定的内容有不同的认识。无罪推定不是一个简单的条文表述，更重要的是通过具体制度的构造，使这一原则具体化。本文将从无罪推定的内容入手论述无罪推定的具体制度要求，以期使这一抽象的原则具体化。
