| 摘 要： | 本文结合两大法系关于存款所有权归属的法律及理论，分析了存款所有权归属存款人的观点在理论和法律运行中的诸多矛盾，认为存款所有权归属于银行，才能为银行运用存款衍生的其他金融关系建构合理的逻辑前提。
