| 摘 要： | 长期以来,刑事政策并不为公共政策领域所接纳。一方面是由于刑事政策的外延过宽或过窄,与公共政策的外延相冲突;另一方面是由于公共政策体系的局限性,现有的建构无法为刑事政策提供存在空间。要明确刑事政策的公共政策定位,必须从上述两方面着手,协调刑事政策与公共政策概念的外延,调整公共政策体系的建构。

| Abstract: | For a long time,criminal policy can＇t be admitted by the field of public policy. On the one hand,the extension of the concept of criminal policy is either too wide or too narrow,which conflicts with the concept of public policy. On the other hand, the system of public policy can＇t provide any space for criminal policy. In order to find the position for criminal policy in the system of public policy, we have to adjust the extension of the concept of criminal policy and the system of public policy. |
