| 摘 要： | 对上海市浦东新区人民法院政府信息公开案件基本情况的分析表明,政府信息公开诉讼中对原告申请内容的审查标准、政府信息的认定以及政府信息的真实性、公开义务的认定方面尚存在一些问题,建议从标准的设置与适用、政府信息范围的可操作性范畴、诉讼类型化以及确立案例指导制度等方面来完善政府信息公开诉讼制度。

| Abstract: | Based on the analysis of disclosure of government information of People＇s Court of New Pudong District in Shanghai,it points out that there are some problems regarding the review standard of prosecutor＇s application,the assertion of government information,the authenticity and the duty to disclose of the government information.It is suggested that government information disclosure litigation be perfected by standard setting and application,maneuverability category of information scale,typification of lawsuits and establishing case guidance system. |
