矿业权理论研究评述

矿业权是明确矿产归属的物权、可以开发的特许授权和实际开发的企业产权复合而成的权利集合体,矿业权所属的探矿权与采矿权的基本构造与矿业权相同。矿业权是并不存在的权利,国外没有矿业权理论和制度,日本和韩国矿业立法规定的矿业权与我国的矿业权理论完全不同。我国矿业权理论源于对日本矿业权制度的"异化"而影响至今。虚无的矿业权导致我国矿业制度落后于市场经济发展的迫切要求,导致矿业制度的诸多困境、两难。应当撤销虚无的矿业权理论,将矿产物权、特许授权和企业产权三者并列,以此构建现代矿业制度。

Comment on the Research of Mining Theory

Mining is a complex set of rights,including mineral ownership of property,the special license and rights aggregate mixed by the actual enterprise property.Exploration and mining rights have the same structure with mining.Mining rights does not exist,and other countries do not have mining system and theory.Japan and South Korea＇s mining legislation are different from China＇s mining theory.China＇s mineral rights theory is derived from Japan＇s mining system of ＂alienation＂.Nothingness of the mining rights leads to the backwardness of our mining system,and mining system has many difficulties.Nothingness of mining rights should be revoked,and mineral property rights,licensing and corporate property rights should be put at a same level,in order to build a modern mining system.
