浅谈治安检查权

自我国公安机关成立并开始履行治安行政管理职能之时起,检查就作为行政执法的一种基本方法,被公安机关广泛使用。治安检查主要包括办理治安案件中的检查、安全检查以及日常的监督检查。办理治安案件中的检查是一种证据调查活动,日常监督检查是一种日常的管理活动,安全检查是指对人民警察对查获或者到案的违法嫌疑人的人身及其携带的物品进行的一种检查活动。法律赋予了公安机关治安检查权,但在操作上不够具体、明确,导致实践中运用治安检查权的混乱,侵犯当事人的合法权益时有发生。因此,正确行使治安检查权,一要明确治安检查权的法律性质;二要能正确区分、理解治安检查权与刑事检查权的不同点;三要注意治安检查不当而导致的法律后果。

Discussing the Check Right of Public Security

When the public security organ of our country establishes and begins to fulfil the administrative management function of the public security,check as a kind of basic method of the administrative law enforcement,is used extensively by the public security organ.Check includes mainly handling the inspection,safety inspection and daily supervision and inspection in the public security case of public security.The check that handles in the public security case is a kind of investigating the activity of evidence,the daily supervision and inspection is a kind of management activity at ordinary times,the safety inspection refers to a kind of checking activity that is carried on to personal and articles carried by illegal suspect who is discovered or appears in court to the people's police.The law gives the check right for the public security of public security organ,but not concrete,clear enough in operation,causing the confusion of the public security checking right in practice using,the legitimate rights and interests of infringing the party happen occasionally.So,it is correct to exercise public security checking right,first is to define the legal nature of checking right;second is able to distinguish,understand the different points of right of public security check and criminal right;third should pay attention to the legal consequence that is caused by incorrect public security check.
