| 摘 要： | 溯源中国的法人精神损害赔偿问题,可以用“一部法律、三个司法解释、两种观点”加以概括。本文以法人存在精神损害赔偿的理论依据、法律依据、实践需要三个方面,论证了法人精神损害赔偿存在的原因,同时对确定法人精神损害赔偿应遵循的原则提出了建议。

| Abstract: | When we trace the history of the compensation for the damage to the spirit of juristic person, we can explain it with 'a law, three units of justice and two points'. This essay demonstrates the causes of the compensation for the damage to the spirit of juristic person from three aspects: theoretical evidence, legal evidence, and practical needs. Moreover, the essay also offers suggestions what principles the compensation for the damage to the spirit of juristic person should follow. |
