现阶段管制刀具管理途径探析

2002年国务院取消涉及管制刀具的四项行政审批项目后,管制刀具的管理进入盲区,《治安管理处罚法》实施以后,取消了对非法制贩管制刀具的处罚,弱化了对管制刀具违法行为的打击力度。尽管公安部要求对管制刀具要依据《对部分刀具进行管制的暂行规定》进行管理,但目前管制刀具的管理基本流于形式。因此,有必要探析现阶段加强管制刀具管理的措施。

Probe into Present Knife Controlling Ways

Since the State Council cancelled four administrative examination and approval projects concerning knife control in 2002,knife control has become a blind spot of administration.Since the implementation of Security Management Punishment Law,the punishment for illegally making and selling controlled knives has been cancelled,too,which has weakened the control of illegal knives.Although the Public Security Ministry requires the controlled knives should be controlled according to the Provisional Regulation on Controlling Some of Knives,nowadays the knife control is basically a formality.Therefore,it is necessary to enhance the knife control.
