边防部门办理刑事案件中特殊侦查行为适用的探析

当前，犯罪分子的犯罪手段日益多样化、隐蔽化、科技化，为了有效制止犯罪，维护社会秩序的稳定，各国在一些特定犯罪案件的侦查中都或多或少采取了一定的特殊侦查行为。边防部门由于侦破案件的特殊性，在实践中对特殊侦查行为也有适用，但由于我国现行法律的缺失，给特殊侦查行为的适用造成了一定的障碍。为此，在实践工作中必须把握住特定案件原则、必要性原则、特定对象原则和审查批准原则，以正确、合法的原则指导行为，从而最大限度地发挥特殊侦查行为对侦控犯罪的作用和效果。

The Analysis of Applicability of Special Investigation Techniques Used by Border Agencies in Dealing with Criminal Cases

Nowadays criminal means tend to be diversified,concealed and technologized. In order to curb crimes and maintain social stability, every country more or less uses special investigation techniques in some specific cases. Because of this special purpose, border agencies use special investigation techniques, too. But owing to the legal shortcomings in our country, which have hindered the use of special investigation techniques, we should learn to know the principles of special cases, necessity and special subjects in real work. Our behaviors should be well and legally guided to maximize the effectiveness of our special investigation techniques in controlling crimes.
