| 摘 要： | 从对<国家赔偿法>第15条第2项的理解看,该法中的"没有犯罪事实"包含事实上的没有犯罪事实和法律上推定的没有犯罪事实两种情况.不起诉案件中被逮捕的嫌疑人就属于国家赔偿法中"没有犯罪事实的人",检察机关应对存疑不起诉案件中被逮捕的嫌疑人进行赔偿.
