结果无价值初论

立足于规范评价的行为无价值与奠基于法益判断的结果无价值的对立及其争执,在大陆法系刑法理论中不仅关系着违法性的评判,而且对犯罪论体系的建构亦具基础性价值,甚至已然超越了违法性领域,嵌入到整个刑法体系、刑法规范及刑法理念之中。中国学界急需在引介评鉴的基础之上进行深入研究。在全球化趋势及当今中国法治化征程中,结果无价值的提倡对于力避刑法中的泛道德主义倾向、有效平衡人权保障和社会保护机能,以及重构中国的犯罪构成理论体系,都具有相当影响。

In the criminal law theory of civil law system,the controversy of Handlungsunwert that bases on norms-reviewing and Erfolgsunwert that founds on judgment of legal interests,not only effects the appraisal of the nature of violating law,but also has basic value to the criminal theory system,even the influence has surpassed the field of illegality,then strode into the whole of the criminal law system,criminal norms and the conception of criminal law.We must carry on deep research urgently based on introduction and reference.In the course of globalization and realization of nomocracy,the proposed Erfolgsunwert has very important effects on avoiding criminal law in flood of morality,balancing the defence of human rights and the protection of society and reconstructing China's crime constitution system.
