中国传统社会构建和谐社会之路径初探——以“情”、“理”、“法”为切入点

近年来，在中国学界，和谐及和谐社会已成为十分凸现的论题。“情理法”不仅是中国传统社会法律研究中的重要论题之一，也是中国传统社会和谐思想的重要体现和中国人建构其所认同的和谐社会的重要途径。通过对“情理法”抑或“情”“理”“法”进行语义上的分析和梳理，再从中国传统社会中的“情理法”的相互关系及其功能角度进行考察，不难发现中国传统社会是如何建构和谐社会的，从而启示我们对当下我国学界和谐社会的研究进行反思。这是很有必要的。

A Preparatory Exploration for Constructional Path of Harmonious Society in the Traditional China——Taking Qing,Li and Law as An Example

In recent years, harmony and harmonious society have been an outstanding topic in nowadays Chinese research circle. Qing, Li and Law is one of the most significant and crucial issues of study of law in traditional society of China. It is also a very embodiment of harmony theories in traditional society of China and an important path well - accepted by which the harmonious society was designed and constructed. It is necessary that how the harmonious society in traditional China was designed and constructed is been tentativly explored through the semantic analysis of Qing LI Law or Qing, Li and Law , their mutual relation and their function and the present research of the harmonious society is questioned.
