| 摘 要： | 选择适用的冲突规范在当代获得了极大的发展。这一发展在人身权、自然人的行为能力、法律行为的方式、合同、侵权行为、亲属、继承等领域均有体现 ,其主要是由于当代经济全球化的客观需要及冲突法对实质正义所追求所引起的 ,同时 ,民法的私法性质及比较法学的发展和互联网的出现亦为其发展创造了有利条件。中国国际私法应当在相关领域加大选择适用的冲突规范的制定

| Abstract: | Choice rules for regulating the conflict of law gets great development in contemporary times.We can see its development in the field of status right, capacity of natural person,form of legal act,contract,torts,family succession,and so on.Its development ismainly due to economical globalization in contemporary times and substantial justice that conflict law presumes,moreover,private nature of the civil law and the development of comparative law and the advent of internet also provide condition for its development.China private international law should provide more choice rules for regulating the conflict of law in relative. |
