文化产业发展的地方立法探究——以山西省为例

近年来,山西文化产业飞速发展,迫切需要对其进行地方立法。从法律依据、立法条件及环境而言,地方立法具备可行性。在立法过程中,应遵循社会效益与经济效益并重,注重保障公民文化权利,尊重文化产业发展自身规律,以保护创意为核心等立法原则。在立法设计上应包含总则、文化产业促进制度、文化市场管理制度、法律责任部分等内容。

Exploration on Local Legislation for Development of Culture Industry in Shanxi

In recent years, the culture industry in Shanxi Province has developed in high speed, so local legislation should be set up urgently. Based on the law, legislative condition and circumstance, the local legislation is feasible. In the process of legislation, we should follow some principles, which are equal regard of social benefit and economic benefit, guarantee of cultural rights of citizen, respect of the law of development of culture industry, and protection of creativity. In the design of legislation, it should contain general rules, the system of promotion of culture industry, the system of management of culture market, legal responsibility and so on.
