摘    要:目前,我国高等教育领域的纠纷呈逐渐上升趋势。从本质上看,高校与学生因管理行为引发的法律纠纷,实际上是高校自治的管理权力与学生受教育权利之间的冲突。为使二者的权利义务达到平衡状态,要求包括立法权、行政权和司法权的国家权力介入纠纷的解决.也要处理好国家权力介入程度的问题。

Abstract:At present, our higher education dispute gradual upward trend. Essence, colleges and students as a result of management behavior caused by legal disputes, is actually University autonomy of management authority and the students the right to education. As to strike a balance of rights and obligations of State, there must be national powers--legislative and executive powers and jurisdiction to intervene in dispute, but also dealt with in the power of the State intervention is a matter of degree.
