社区矫正公益劳动的价值

建立合理有效的社区矫正公益劳动制度,首先应合理定位社区矫正公益劳动的价值。本文认为,应把公益劳动作为假释类、缓刑类社区服刑人员的刑事义务。公益劳动的刑事义务以其补偿犯罪行为对社会、社区的危害及矫正犯罪人、促使犯罪人顺利回归社会为合理根据。应以社区矫正公益劳动价值定位为指导,探索构建社区矫正公益劳动制度,进而实现社区矫正公益劳动的价值目标。

Value of Labor for Public Benefits in Community Correction

To establish a reasonable and efficient system of labor for public benefits for those who are under community supervision,we should first fix the value of such labor.This article holds that labor for public benefits should be regarded as criminal compulsion on offenders like probationers and parolees under community supervision.Criminal compulsory labor for public benefits takes it as the rational basis that such labor functions as offenders＇ compensation for the harm they do to the society and the community because of their criminal behavior,and that such labor can help correct offenders and ensure their smooth return to the society.We should explore how to design a system of criminal compulsory labor for public benefits for those who are under community supervision under the guidance of value orientation,so that we can realize the value target of such labor.
