| 摘 要： | “山寨文化”看似简单的一个社会现象，其实可以透视出我国改革开放三十年法治建设的得失。它的出现首先表明了一种个体的独立和权利意识的觉醒，同时也反映我国法治建设中的理性的缺乏。从法哲学角度对“山寨文化”加以分析和探讨，并以此为视角对我国改革开放三十年法治建设进行检讨，对于我国法治建设走出山寨困境有着重要的理论和实践意义。
