海域使用权基本法律问题研究

我国有着辽阔的海域及其资源与环境。为合理、有效地开发利用海域,必须建立和完善海域使用权法律制度。海域使用权由海域所有权派生而出,包括海域的占有、使用和收益权能;海域使用权属于用益物权,具有用益物权的一般效力和自己的特殊效力;海域使用权的设定,主要包括海域使用审批制度和海域有偿使用制度。

The Research Into the Basic Legal Problems of the Rights of Sea Use

There is large-scale sea region, resources and environment in China. In order to use sea region efficiently, we have to set legal systems upon the right to use and perfect them. Born from ownership of sea, the rights to use of sea region include the rights of occupation, use and harvest. The rights to use belong to the right to use and benefit. They have the common effect of the use and benefit as well as their own special effect. The setting systems of the rights to the use of sea region mainly have the examining system of the use of sea region and the pay system of the use of sea region.
