There are many problems concerning compulsory measures in the legislation and judicial practice. The law enforcement organs implement the arrest in most cases, apply more detention than living under surveillance, and seldom use the summons for detention. The procuratorial organs employ more recognizance upon bail than the public security organs do. The principles of function-realization, necessity and moderation should be regarded to ameliorate the provisions criminal compulsory measures.
