| 摘 要： | 目前学者们对正当防卫问题的意见分歧 ,主要集中在可实行正当防卫的不法侵害的范围、防卫的限度、防卫过当的罪过形式等问题上。为了精确一般防卫、特殊防卫、防卫过当的成立条件 ,发挥刑法设立正当防卫制度的功能 ,有必要根据刑法规定正当防卫制度的精神 ,从理论与实践相结合的角度对这些争议问题作进一步的研究。

| Abstract: | At present, the arguments on justifiable defense are mainly concentrated on the questions on the scope of unlawful infringement of allowable defense, defense limit and offence forms of defense of exceeding limit, etc. In order to precisely establish constitution conditions of common justifiable defense, special justifiable defense, defense of exceeding limit and to exert the function of justifiable defense system, we should deeply study these disagreements by way of conjoining theory and practice in the light of the spirit of justifiable defense system stipulated by the criminal law. |
