论医疗损害责任之举证责任分配

举证责任及其分配在医疗侵权诉讼中具有重要地位,我国的《侵权责任法》坚持了过错责任原则在医疗侵权损害赔偿中的主导地位,同时针对医疗侵权行为的特殊性,以附条件的过错推定原则为辅,但在因果关系与过错的认定举证责任分配上,我国现行的医疗损害举证责任分配制度仍存在一定不足,需要进一步制定举证责任缓和等具体规则,以及建立科学的医疗损害责任鉴定制度。

A Study on Distribution of Proof Burden of Medical Damage Liability

proof burden and its distribution have important position in medical lawsuits,in the Tort Law of our country,Fault liability Principle play dominant role in medical tort damages cases,due to the particularities of many kinds in medical services,complemented by conditional constructive fault principle in medical tort damages cases.For the identification of causal relationship and identification of fault,however,further specific rules to mitigate proof burden is in need,and scientific technical appraisal for the medical negligence system should be established.
