评论侵权法律问题研究

评论权和名誉权是实现公民合法权益的两种体现。同时,二者之间存在交叉性,评论权使用过度将会构成名誉侵权。当前名誉侵权案件频发让我们不得不思考评论的合法性问题。为了更好地实现我国既保护名誉权又保护评论权的司法理念,有必要以"评论"为出发点进行初步探讨。

Study on Issue of Law on Tort in Comments

Right to comment and right of reputation are two embodiment of achieving the legitimate right and interests of citizens.At the same time,there is overlapping between them.If right to comment is overused,right of reputation may be infringed.We have to think about the issue of legitimacy,since defamation cases happen with increasing frequency.In order to have a better protection for the right to comment and right of reputation simultaneously,this paper makes an investigation using comments as a point of departure.
