| 摘 要： | 我国社区矫正的困境主要体现为:社区发育先天不足,社区矫正认同程度不高,社区参与不足,社区矫正对象的面子问题与自我封闭,社区矫正法律滞后与机构设置不合理.我国社区矫正的困境超越需要做到:转变重刑观念,加强政府帮扶;加强社区建设,有效利用社区资源;完善社区矫正的主体,理顺社区矫正的体制;完善社区矫正立法,使社区矫正有法可依.

| Abstract: | Community correction plight in China mainly incarnated as following: community growth suffer from an inadequate natural endowment,community participation is insufficient,community correction objects’ face problem and self-containment,relative legislation lags behind mechanism setup is not reasonable.The transcendence of community correction plight in China requires following measures: change heavy penalty notion,enhance government assistance;enhance community construction,make good use of community resource;consummate subjects of community correction,untangle mechanism of community correction;consummate legislation of community correction so that there are laws to go by. |
