| 摘 要： | 理清BOT项目融资模式中合同当事人及其之间的法律关系,有益于发现目前BOT融资模式相关立法制度中和实践中存在的法律问题,以期能够在项目实践的改进和将来的立法、修法中,为我国BOT项目融资法律制度的发展建言献策.

| Abstract: | With the analysis of China’s relevant legal system of BOT financing model,the author try to figure out the legal relationship between the contract parties of the project financing of BOT and thus find the legal problems existed in current practice and design of legislation system.For these problems,the author investigates the background of their theory and practice,expecting that in the future improvement of practical project and legislation aspects,it can contribute to the development of China’s legal system of BOT project financing. |
