论诱惑侦查的相对合理主义

诱惑侦查作为一种特殊的侦查手段，在我国司法实践中一直被广泛地运用，但在立法上并无明确的规定，从而导致实践中的混乱及滥用并引起极大争议。但实际上，这个问题的讨论不能简单化，应在追求相对合理的前提下，一方面使诱惑侦查这种有效的侦查措施继续存在，另一方面针对其可能带来的弊端而进行规范，最大限度地降低其负面影响，以实现诱惑侦查应有的价值。

On Relative Rationalism of Trap Detection

As a special detective means, trap detection is widely exercised in the judicative practice of our country, but it is not explicitly stipulated in the legislation, leading to confusion and abuse in the practice along with heated disputes accordingly. But in the actual fact, this question cannot be discussed in the simplified way. Relative rationalism being sought as a precondition, trap detection should be let exist as an effective detective measure on the one hand, and it should be normalized in allusion to its possible abuse with the negative impact minimized and the due value achieved on the other hand.
