| 摘 要： | 修订前的《民事诉讼法》,检察机关提出抗诉的条件只是原则性地规定了四种情况,缺乏可操作性。2008年4月1日起执行新修订的《民事诉讼法》,对此作了较大的修改,对"事实认定错误"、"适用法律错误"、"程序违法"等进行准确理解和适用,及时转变观念、加强调研,正确把握好修改后的抗诉条件成为当前检察机关开展民事抗诉工作的首要任务。
