| 摘 要： | 本文根据刑法第 1 38条规定的精神 ,从法理与司法实践相结合的角度 ,对教育设施重大安全事故罪的主体范围、“明知”要素的含义及罪过形式问题进行了比较细致、深入的分析 ,并提出了作者自己的一些见解。

| Abstract: | Based on the spirit of Article 138 of the Criminal Law and from the view of the combination of the jurisprudence and the judicial practice, this article analyses, in a relatively meticulous and deep way, some issues of the crime of negligently causing a serious accident to the security of educational facilities, including the scope of its subject, the meaning of its element of "knowingly", and its culpability form. The author has put forward some ideas about some of the issues mentioned above. |
