中国传统犯罪构成理论缺陷析

判断犯罪构成理论优劣的标准应该有三个,即逻辑性、实用性以及法的实质安全性。基于以上标准,中国传统犯罪构成理论存在着如下缺陷:在逻辑性上,传统理论将整体划分为不同部分的思考方式,使使用者对体系的认识发生价值前置的逻辑混乱;在实用性上,传统理论的分离式思维不具有思维方式上的合理性;在法的安全性问题上,传统理论因为犯罪构成与正当化事由的分治格局只具有入罪口而缺少出罪口,可能影响刑法正义目标的实现,并且这种缺陷是由其自身造成的,无法通过对自身的改良来实现。因此,传统犯罪构成理论应在犯罪构成理论构建的价值前提指导下予以重构。
