| 摘 要： | 公司人格混同是人格否认法理的适用要件之一,在对其进行认定时应突破"人格形骸化"的局限,同时应从理性第三人的角度对于债权人是否会将多个公司混淆做出判定。在规制人格混同现象方面,应侧重于完善社会中介机构的监督职能以及股东的信用机制。
