| 摘 要： | 侦查有若干区别于司法的特征。基于侦查的取证组证功能,其在案侦过程与侦查程序、程序规范与"任意侦查"、终结侦查对任意性的规范等方面具有若干区别于司法的职能特征。侦查需要发现、收集和固定证据,同时组织证据体系。侦查对策应在法律的刚性与弹性中研究刑侦规律和取证、查证、组证的技巧。

Its function characteristics are including, in the course of investigation and investigative procedure, program standard and optional investigation, the investigation of final stage and optional standard. The investigation must find evidence, collect evidence, fixed evidence, and the same time, organized the evidence. |
