| 摘 要： | 《刑法修正案（七）》第十三条利用影响力受贿罪的设立，彰显了我国从严惩治贿赂性犯罪的立法倾向；该罪主体中的“关系密切的人”的标准与范围以及客观方面对“利用影响力”的解释，关系到罪与非罪、此罪与彼罪的认定；利用影响力受贿罪在立法上存在完善的空间，并且与受贿罪存在竞合关系。

| Abstract: | The enactment of taking bribes with good offices as stipulated in Article 13 of The Amendment of the Penal Code （7） indicates our country＇s determination to curb bribe -related crimes. However, the criteria to specify ＂persons closely related＂ and the interpretation of ＂taking advantages of influence＂ should be crucial to the establishment of a crime. |
