| 摘 要： | 无被害人犯罪是犯罪学上的一个特殊类型,对之进行研究的目的就是探究是否能够对之进行非犯罪化,因此在刑法学上属于＂待非犯罪化＂的犯罪。无被害人犯罪并非没有被害人,而是当事人不认为自己是被害人,因此,无被害人犯罪能否被犯罪化在于该种行为是否对法益造成侵害或者威胁。

| Abstract: | From the day researching this kind of crime,the purpose is clear that it is to discuss the decriminalization of victimless crimes.So in the view of criminal law,victimless crimes belong to ＂crimes to be decriminalized＂.In victimless crimes there also exist victims,but the victims themselves don＇t think they have been hurt.So whether the victimless crimes could be decriminalized depends on weather the legal interest has been infringed or not. |
