“性恶论”视野下之职务犯罪问题思考

我国的主流思想历来坚信人性本善,然而在职务犯罪中,对人性的过于信任,难免会让人陷入道德理想主义的泥潭,这不利于职务犯罪的惩治和预防。将性恶论的思想引入职务犯罪体系,一方面,可以促使监督者以看待犯罪嫌疑人的姿态来审视权力者,这有利于监督者加大对权力运行的监督力度;另一方面,公职人员也会以权力的危险性来认识权力,这有利于公职人员在行使职权时提高警惕,时刻自我监督和自我内省。

Thoughts on Occupational Crime from Perspectives on Human＇s Evil-side Nature

In consequence,introduction of the theory of original evil of human nature into the occupational crime system may help to surmount the shortcomings present.Trough the comparison of theories of original evil of human nature in the eastern and western culture,this paper illustrates the reasons of introducing the theory of original evil of human nature and makes a genetic analysis of the occupational crime based on the idea of the original evil human nature of civil servants in China with relevant problem-solving strategies provided.The author argues that introduction of the theory of original evil of human nature into the occupational crime would,on the one hand,encourage supervisors to examine the power-possessors by taking the attitude of treating a suspect,which is beneficial for supervisors to enhance the supervision of power operation.On the other hand,it helps civil servants to re-understand power on the ground of power fatalness,which urges them to enhance their vigilance in the process of discharging duties by timely self-supervision and auto-criticism.
