| 摘 要： | 我国刑法于1997年修订后，明确规定了单位可以作为一类的犯罪主体。但我国对于单位犯罪，无论是理论还是实践，其发展都不够成熟。因此刑法理论界对单位犯罪的诸多方面仍然存在分歧，司法实务中对于大量疑难案件的处理也有待商榷。在单位犯罪的内部结构中，单位自首的问题是较为重要的问题。

| Abstract: | The Criminal Law of PRC revised in 1997 expressively stipulates that the unit is one of subjects of crime. On unit crimes, both in theory and practice, our research are immature. So there are some differences about recognizing the surrender of the units in the theory, which causes some chaos in the judicial practice. |
