入户盗窃向入户抢劫转化型犯罪探究——以黄某案量刑配置为例

本文通过案例分析 ,提出作者观点 :认为对入户盗窃向入户抢劫转化型犯罪的量刑配置 ,应以非法入户为前提进行把握 ,以抱不法动机非经居住人同意擅自入户者 ,或虽经同意入户但居住人要求其退出而拒不退出者 ,为非法入户 ,非法入户盗窃因法定事由转化为抢劫罪的 ,其量刑配置应按入户抢劫论处 ;合法入户而生窃念者 ,在盗窃过程中被发现 ,为抗拒抓捕……而当场使用暴力或以暴力相威胁的 ,其量刑配置应以一般抢劫罪论处。

Research on Crime of Steal by Entering House Changinginto Robbery by Entering House

With analysis on some certain case, the author believes that the measurement of penalty for robbery by entering house changed from steal by entering house should depend on a precondition of illegally entering others' houses. Stealing with illegally entering house should be measured as robbery by entering house. One who is caught stealing and resists arrest by using violence or threat of violence should be measured with the crime of common robbery.
