| 摘 要： | “诱惑侦查”或称“警察圈套”,是一个行之有效的侦查手段。但是,我国法律、法规或司法解释都未对此作出规定,实践中经常对其合法性以及带来的法律责任问题产生争议,引起混乱。本文初步探讨了诱惑侦查合法性应当具备的主体、主观、客观、客体四个要素,并在此基础上分析了诱惑者的法律责任问题。

| Abstract: | The enticement investigation,namely police's entrapment.It is an effective investigativemeans.But it didn't stipulate in Chinese law,regUlation and judicial interpretation.In practice,we often dispute the rational and it's legal duty.The author probed into the subject,object,subjective,and objective of the enticement investigation rational,and analyzed the legal duty of the investigator. |
