| 摘 要： | 我国立法的不统一不协调,导致赃物善意受让人的利益保护长期处于被忽视被排斥的尴尬境域。保护赃物善意受让人的利益具有法理之应然性与伦理之正当性。为了更好地保护“善意”交易,应赋予赃物善意受让人多元化的救济途径,现行立法理念与执法机制应当适当的革新。

| Abstract: | Because of the indeterminacy of our legal system,the bona fide transferee's interests were in a poor state of being neglected or excluded for long time.There exist jurisprudential ought-to-be essence and ethical justification to protect the bona fide transferee's interests.In order to maintain the trade safely,and encourage bona fide purchase,the bona fide transferee should be entitled to protect his or her interests in more ways,and our legal system should be innovated properly. |
